Hardware Warranties.
Repetix warrants Products against defects in materials and workmanship under normal use (the “Warranty”) for the following warranty periods:
(a) For products purchased by account before November 15, 2022, for which you have paid all related fees for Products and Services in full (“Owned Products”):
- If the account has remained active and the subscription is in “good standing” (meaning account has continuously paid the subscription fee) since the purchase, the “Player Devices,” (meaning Repetix provided hardware worn exclusively by the players during practice and in-game) including the physical device, its case, battery, and screen, will remain under the 100%, full coverage warranty as long as the account’s subscription stays in “good standing”;
- If the account is no longer active and/or the subscription is not in “good standing,” the devices are no longer covered under warranty and will no longer be eligible for coverage. No exceptions.
- If devices are no longer eligible for warranty coverage, the account can make a one-time extended warranty purchase of $120 per unit, PLUS the cost of the subscription fee to bring the account into “good standing” and cover the devices under warranty. Ownership of the devices MUST be transferred back to Repetix, Inc. If devices were purchased before December 31st, 2020, NO EXTENDED WARRANTY OPTION IS AVAILABLE.
(b) For Products leased to account by Repetix after November 15, 2022 (other than any replacement units for Owned Products purchased before November 15, 2022), during your Subscription period, provided the account remains current with the payment of all fees for Products and Services, Repetix will grant:
- The “Player Device” (meaning Repetix-provided hardware worn exclusively by the players during practice and games) has a 100% full-coverage warranty against normal wear and tear (including breakage). This includes the following items: the screen protector, the screen, the device strap/band, the battery, and the buttons. The “Player Device” will remain under warranty for as long as the account’s subscription is in “good standing.” This warranty does not cover lost/stolen items. If a “player device” is lost/stolen and isn’t recoverable, the account holder is responsible for any applicable charges related to replacing the hardware device.
- The “Coach Devices” (including handheld devices and tablets provided to accounts by Repetix for the sole use of Coaches from the sidelines and/or dugout during practices and games) have a Limited, Lifetime Warranty that covers all defects and/or malfunctions related to normal use cases including, but not limited to software malfunctions, networking issues, firmware malfunctions, battery charging/storage issues, and other use-related issues as determined by Repetix, Inc. The limited lifetime warranty DOES NOT INCLUDE what is deemed excessive, abusive, or negligent use, such as, but not limited to, cracked/broken screens, damaged casings, dropped devices, stepped on devices, or lost/stolen items. Application and acceptance of a limited, lifetime warranty claim is at the discretion of Repetix, Inc. upon return of the damaged tablet/handheld. Any applicable charges related to fulfilling the warranty claim are the sole responsibility of the customer. The limited lifetime warranty remains in effect as long as the account's subscription is in “good standing”.
This Warranty is void AND does not apply to either the “player device” or the “coach device” where: (a) damage caused by accident, abuse, misuse, neglect or failure to properly maintain (to include but not limited to water damage and/or condensation or improper temperatures during storage), or improper installation; (b) damage caused by electrical disturbances or acts of God, to include but not limited to civil disturbance, war, flood, fire, rodents or insects; (c) damage caused during shipment (due to your improper packaging) from you to Repetix in the case of Products returned for repair; or (d) damage caused by failure to follow our instructions regarding appropriate use of Products, including the method in which players and coaches wear the Products. Any Warranty claims that fall under the above clause are the full responsibility of the account, and the account will reimburse Repetix, Inc. the full retail value of the lost equipment within thirty (30) days of the claim.
During the period when our Warranty is in effect, Repetix will provide technical support to you so long as you have paid all fees for Products and Services when due. Repetix will respond to your support problems by phone or by email inquiry. If a support problem cannot be rectified via phone or email, you will be provided with return instructions, and Repetix will, at its option, repair or replace any defective Products.
If Repetix discovers that the Warranty is inapplicable, the Products will not be repaired and will be returned to you at your expense unless you authorize and pay for repair. Whether you authorize repair or not, Repetix reserves the right to charge a “No Fault Found” fee when the Products are found not to be defective due to any fault of Repetix.
Product and Services Disclaimers/Limitations.
Repetix disclaims all other warranties, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or against hidden or latent defects.
Repetix’s responsibility for warranty claims is limited to repair or replacement. Repetix does not warrant that the Products, Services, or any networks or systems accessed by the Products will be free from vulnerability, intrusion, attack, or other damage. Repetix does not warrant that the operation of the Products or Services will be uninterrupted or error-free. Repetix is not responsible for damage arising from failure to follow instructions relating to the use of Products or Services. Our Warranty is voided immediately if repair, modification (to include upgrades, expansions, or usage or addition of non-manufacturer parts or accessories), alteration, or other service is attempted other than by Repetix.
Declined Payment Fee: In the event that any payment due under this Subscription Agreement is declined for any reason, the Subscriber shall be liable for and agrees to pay an additional administrative fee of three hundred fifty United States dollars ($350.00) or up to the highest amount allowed by state law. This fee is intended to cover the administrative costs associated with processing the declined payment and managing the resulting account status. The subscriber acknowledges and agrees that this fee is a reasonable estimate of such costs. The Company reserves the right to suspend or terminate access to the Subscription Services in the event of a declined payment and failure to remit both the outstanding balance and the declined payment fee within fifteen (15) days of notification of the declined payment.
